END‑USER CERTIFICATE

Purchaser acknowledges that certain items attempting to be purchased (the “Item(s)”) from Spiritus Systems Company (“Spiritus”), including firearm magazines and ammunition feeding devices, are subject to federal, state, and local laws and regulations governing their sale, shipment, transfer, possession, and use. As such, Spiritus must obtain certain information from Purchaser to comply with said laws and regulations.

Certain U.S. jurisdictions restrict the sale and transfer of firearm magazines and other firearm accessories. Military and law enforcement are typically exempt from these restrictions. Spiritus Systems does not process sales or shipments prohibited by law. There are certain exemptions to each of these restrictions that allow active law enforcement, military personnel and other specifically authorized persons to purchase restricted product. Purchasers seeking to complete a purchase under a qualified exemption must contact Customer Support at generalsales@spiritussystems.com prior to placing an order.

Purchaser hereby certifies, represents and warrants that:

1. The End User of the Item(s) is the Purchaser of the Item(s), whose full name and shipping address shall be listed on the Checkout Page of this order.
2. The End User will only use the Item(s) for legal purpose(s).
3. The End User is legally allowed to purchase, receive, possess, and use the Item(s) under all applicable federal, state, and local laws and regulations, including those applicable in the jurisdiction where the Item(s) are shipped.
4. The End User affirms that the Item(s) are lawful to be shipped into, received, and possessed in the destination jurisdiction, and acknowledges that certain jurisdictions restrict or prohibit the sale or possession of firearm magazines based on capacity or other characteristics.
5. The End User will not sell, transfer, loan, export, or otherwise dispose of the Item(s) in any manner that violates federal, state, or local laws or regulations.

Purchaser agrees to indemnify and hold Spiritus harmless from all damages, costs, fines, penalties, reasonable attorney fees, and all other expenses arising from a claim or demand from any governmental entity that alleges Spiritus failed to comply with federal, state, or local laws and/or regulations pertaining to this transaction between Purchaser and Spiritus.

Spiritus reserves the right to cancel Purchaser’s transaction for any reason and at any time, including after payment has been made.
